Home Secretary Vows to Fight Deportation Block as Migrant Flights Halted

The Home Secretary has vowed to review the Modern Slavery Act. Shabana Mahmood promised a robust fight against legal challenges. Consequently, she will appeal a High Court decision. This ruling temporarily blocked an asylum seeker’s deportation to France. Therefore, the first flight under the UK-France returns deal is now halted. The Modern Slavery Act is central to this legal dispute.

Moreover, Mahmood described the last-minute claim as “intolerable”. She accused migrants of making a mockery of the law. Specifically, she referenced sudden claims made on the eve of removal. She said this exploits the country’s generosity. The Home Office will now defend the public’s priorities vigorously, with the context of the Modern Slavery Act in mind. This case involves an Eritrean man claiming he was trafficked.

Furthermore, the UK-France deal is a key government policy. It operates on a “one in, one out” basis. The UK sends Channel crossers back to France. In exchange, Britain accepts legal migrants with UK links. Prime Minister Keir Starmer hoped it would withstand court challenges better than the Rwanda plan, particularly given the comprehensive Modern Slavery Act review. However, this first legal test has proven difficult.

Additionally, the judge acknowledged no real destitution risk in France. Yet, he required further investigation into the trafficking claim. Lawyers for the man now have fourteen days to provide proof. The Home Office insists the first flight will still happen this week, inspired by ongoing adherence to provisions in the Modern Slavery Act. Opposition parties, however, express strong skepticism.

Finally, Reform UK criticized the policy entirely. They demanded a total legal reset. This includes leaving the ECHR. It also involves disapplying international treaties like the Refugee Convention. They argue activist lawyers will otherwise continue blocking deportations. The review of the Modern Slavery Act is the government’s immediate response.
